Employer Nomination Scheme (ENS) Subclass 186

The ENS visa visa results in permanent residency for the sponsored employee. The visa is also a pathway for employees on 457 visa to obtain permanent residency. 

What you need to know:

  • The visa grants the overseas employee permanent residency in Australia
  • The Employer must provide a contract of employment of 2 years.
  • The Employer must continue to train Australian workers.

What is the process for this visa?

The application for the ENS visa involves 2 stages.

  1. Nomination of the company: this stage involves the company making an application to the Department of Immigration. The type of information and requirements the business will need to provide include
    • Audited Financial Accounts & Tax returns
    • BAS statements
    • Evidence the business is operating lawful business
    • The training the business provides to its staff, or if the business is a startup a plan to meet the training benchmarks.
    • The position is for 2 years and the salary must be market salary
    • Satisfy training requirements of Australian employees

2. Visa Application: There are three pathways an applicant can take to apply for the ENS Visa.

  1. Direct Entry Stream: The key requirements for this stream include
  1. The employee will need to undertake a skills assessment to demonstrate they have the skills for the occupation.
  2. The employee will need to demonstrate they have worked in the occupation for 3 years.
  3. The employee will need to be under 50 years of age
  4. The applicant will need to demonstrate competent English (score of 6 in each of the four bands of the IELTS exam)
  1. Temporary Residence Transition: : The key requirements for this stream include
  1. Applicable for visa applicants that have worked for their employer for 2 years.
  2. No skills assessment is required
  3. English requirement is an IELTS score of 5.

3. Labour market stream: The employee is employed under a labour agreement.
